Definitions
- “Contractor” means SnowForce Services;
- “Customer(s)” refers to any party to whom the Contractor has agreed to provide snow clearing and related services;
- “Serviced Area” means the Customer(s)’ driveway, walkways, or other areas agreed upon;
- “Snow Clearing Services” means removal of snow from the Serviced Area using mechanized or manual equipment to an acceptable nearby location such as the lawn or designated snow storage zones;
- “Subject Property” means the location at which the Customer(s) has contracted the Contractor to perform services;
- “Term” refers to the service period starting November 1st and ending April 15th or once 400 cm of snow has been cleared as recorded by Environment Canada in Barrie, Ontario.
Service Authorization
- The Customer(s) authorize the Contractor access to the Subject Property throughout the Term to carry out services.
Service Timing
- Services commence after a minimum snowfall of 5 cm;
- Snowfalls under 5 cm are not automatically cleared;
- Service timing may vary based on snowfall volume and weather conditions;
- No overnight service is guaranteed for snowfall under 7 cm;
- Follow-up visits after municipal plowing or during prolonged snowfall are included.
Markers and Obstacles
- SnowForce will install two standard driveway markers prior to service;
- Additional markers (for retaining walls, steps, or other fixed structures) must be requested and paid for by the Customer;
- Customers must remove or secure all portable items in the Serviced Area prior to snowfall (e.g., bins, sports equipment, lighting).
Snow Storage
- Snow will be stored on-site in agreed-upon or feasible areas. If no suitable location is available, arrangements must be made by the Customer.
Exclusions
- Unless separately contracted, services do NOT include:
- Hauling snow off-site
- Stacking, sanding, salting, or de-icing
- Removal of ice or compacted snow
- Slush removal from uneven surfaces
- Clearing snow resulting from roof slides or drifting
Walkway Shoveling (Add-On Service)
- Only included if specified in contract. Includes:
- Front steps and garage walkways;
- Performed within 24 hours after snowfall ends;
- Does not include drifting, ice from freezing rain, or roof-fall snow.
Payment Terms
- Full season pricing and payment options are outlined at the time of contract;
- Accepted methods: cash, bank draft, or e-transfer. No cheques accepted;
- Payments are due as agreed, with a 1% interest applied bi-weekly to overdue accounts;
- Refund only available if Customer cancels within 24 hours after the first service visit and meets all guarantee terms.
Guarantee & Credit
- If unsatisfied after first 5 services, Customer may cancel and receive a full refund;
- Customers with fewer than 12 visits and less than 200 cm of total snowfall will receive a $50 credit toward the next season.
Customer Responsibilities
- Maintain 12 ft clearance in driveways;
- Remove downspouts, caps, and overhanging nets/structures;
- Ensure accurate driveway size disclosure;
- Contractor not liable for damages to items not removed or falsely reported dimensions.
Vehicles
- Driveways blocked by vehicles will only be serviced in accessible areas. Repeat visits will not be performed for inaccessible driveways.
Municipal Coordination
- Contractor is not affiliated with city snow services. Customers may request extra clearing after city plow passes.
Limitation of Liability
- Contractor not liable for driveway surface damage, garden/lawn disturbance, or ice-related accidents;
- Customers are responsible for maintaining safe conditions post-service, including any salting.
Relocation or Sale
- If the Subject Property is sold, the agreement may be transferred within the service area upon request. No refunds issued for relocation.
Termination & Enforcement
- Breach of terms voids the agreement. Customer agrees to pay any enforcement costs, including legal or lien-related fees.
Governing Law
- This agreement is governed by the laws of the Province of Ontario.
